Attorney Herbert A. Brail

Herb worked extensively with adoption and surrogate parenting issues throughout the 1980's and founded the Keane Center for Adoption in 1989 together with the late Noel P. Keane.  Joining the American Academy of Adoption Attorneys (AAAA) in 1991, he served as the Academy President in 2007-2008, currently serves on the Academy Board of Trustees, and is the Academy's President-Elect for 2015-2016.  Accepting only adoption related and assisted reproductive technology (ART) cases out of his Dearborn, Michigan office, he primarily handles domestic infant adoptions with an extensive interstate practice.  He frequently represents individuals and agencies in contested adoption matters.  Due to severe restrictions on surrogacy in Michigan due to a 1988 statute, Herb's ART practice focuses on egg donation, embryo transfers, and uncompensated surrogacy.  A founding member of the American Academy of Assisted Reproductive Technology Attorneys, he has an extensive network of colleagues nationally and internationally who collaborate on cases.

Herb and his law partner, Stephanie, worked extensively with the Michigan Legislature in 2013 and 2014 drafting legislation which allows Michigan birthparents to sign an out-of-court consent in direct placement adoptions bringing Michigan into conformity with the adoption laws of most other states.  He serves on the Michigan Supreme Court Administrative Office (SCAO) Adoption Forms Committee and has presented numerous seminars for the American Academy of Adoption Attorneys, National Business Institute, and University of Michigan Law School Institute of Continuing Legal Education.

He and his wife, Christine, who is the owner and director of the Keane Center for Adoption,, are adoptive parents and have two daughters.

Attorney Stephanie L. Benedict

Stephanie joined the American Academy of Adoption Attorneys after working with Herb since 2007.  She also limits her practice to adoption related cases.  Licensed in both Michigan and California she began her legal career as a litigator in Oakland, California before moving to Michigan.  Stephanie's adoption practice includes direct, interstate, step-parent and family/relative placement, as well as contested adoptions.  She is the Chair of the Adoption Committee of the Family Law Section of the Michigan State Bar, the Co-Chair of the Washtenaw County Bar Association Family Law Section, and serves as a qualified Attorney-Guardian ad Litem.

Stephanie and Herb created exemplar Out-of-Court Consent, Release, and Verified Declaration of Paternity forms used by other attorneys and agencies throughout the State of Michigan.
